By uploading audio and image files to Soundsouvenir.com (the “Site”), you agree to the following terms and conditions:
1. Ownership. You represent and warrant that you are the owner of the copyright or have the necessary rights and permissions to upload and use the audio and image files on the Site. You acknowledge that Soundsouvenir.com does not claim ownership of your audio and image files and that you retain all ownership rights.
2. Compliance with Laws. You agree to comply with all applicable laws, rules, and regulations, including but not limited to copyright and trademark laws, in connection with your use of the Site and the audio and image files uploaded by you.
3. No Guarantee of Privacy. You acknowledge and agree that there is no guarantee of privacy or confidentiality with respect to the audio and image files uploaded by you to the Site. You acknowledge that the audio and image files can be accessed via unlisted URLs that will not be searchable, however, anybody with the exact URL or access to the QR code that links to it will be able to view and listen to the files. You further acknowledge that Soundsouvenir.com may have to share the audio and image files with carefully selected third-party printing providers and data hosting platforms.
4. License. We need your permission to transfer your audio file to our cloud hosting partners and your image file to our printing partners. We will never use them for any other purposes. By uploading audio and image files to the Site, you grant Soundsouvenir.com a non-exclusive, worldwide, royalty-free, transferable, sub-licensable license to use, reproduce, distribute, prepare derivative works of, display, and perform the audio and image files in connection with the operation of the Site and the sale of products containing the audio and image files.
5. Waiver of Claims. You agree to indemnify, defend, and hold harmless Soundsouvenir.com, its affiliates, officers, directors, employees, agents, licensors, and suppliers from any and all claims, demands, damages, costs, and expenses, including reasonable attorneys’ fees, arising out of or in connection with any audio or image files uploaded by you or your use of the Site.
